What to do when in a New Jersey Motor Vehicle Accident
If you have been in an accident involving a motor vehicle, there are three important rules for you to follow:
- Call the police and wait for them,
- Do not discuss the accident directly with the other driver,
- Ask for an ambulance or seek medical attention immediately if you suspect you are injured.
Do not discuss any matters concerning your injuries with the insurance company of the driver who is at fault. You are under no obligation to give them this information and, if you are not careful, you may say something that seems harmless, but it actually is very harmful to your case. Beware of the clever insurance adjuster: he or she does not have your best interests at heart and is actually looking for ways to see that their company pays you nothing or as little as possible.
It is easy to see that you should contact an attorney as soon after your accident as possible; in fact, you may want to contact an attorney right after receiving the first treatment for your injuries. If you are unsure of which physician to go to, I can help you find a physician in your area. Early investigation and preparation will help you learn if you meet the minimum thresholds New Jersey law says you must prove in order to bring an action for non-economic damages, such as your pain and suffering. You may bring an action for non-economic damages if the motor vehicle accident you were involved in caused you or a family member to suffer:
- Death
- Loss of a limb, or other body part
- Significant disfigurement or scarring
- Loss of a fetus
- Displaced fractures or
- A permanent injury, other than scarring or disfigurement.
My extensive experience in handling motor vehicle accident cases means that I know how to prove what is necessary to meet one of these thresholds. If it is legally possible for you to meet one of the thresholds, I am confident that I can help you to prove it.
